For the most part, the construction sector is separately regulated in each State and Territory in Australia.
Fortunately, slow progress is being made towards each State and Territory adopting more uniform Security of Payment legislation for the sector throughout Australia, although important differences remain between each State and Territory.
By popular demand, you can access our updated Australian Construction Industry Security of Payment Legislation Wayfinder below.
Industry participants find the tool useful when operating in different jurisdictions throughout Australia to gain their bearings on the Security of Payment legislation in place in each State or Territory, before obtaining more detailed legal advice or support from our firm on their unique circumstances.
The Wayfinder has also been updated to incorporate the newly legislated (but yet to substantively commence) Western Australian amendments enacted by the Building and Construction Industry (Security of Payment) Act 2021 (‘WA’). This radical overhaul of the Western Australian Security of Payment legislation achieves more alignment with the East Coast model, but with some material differences, and is expected to commence by proclamation soon.
